Acceptance of the Agreement
To use the services provided by Domus Artis srl, you must carefully read and accept the Agreement. Use of Domus Artis implies full acceptance of the Agreement. If you do not wish to accept this document, you must refrain from using Domus Artis.
Third-Party Content
The Owner does not perform any prior moderation of content or links provided by third parties displayed on Domus Artis. The Owner is not responsible for such content or its accessibility.
Third-Party Services
Users may use services or content included in Domus Artis that are provided by third parties, but must first review and accept the terms and conditions of those third parties. Under no circumstances shall the Owner be held liable for the proper functioning or availability of services provided by third parties.
Prohibited Use
The Service must be used in accordance with the Terms. Users may not:

Perform reverse engineering, decompile, disassemble, modify, or create derivative works based on Domus Artis or any part of it

Bypass computer systems used by Domus Artis or its licensors to protect content accessible through it

Copy, store, modify, alter, or create derivative works from any content provided by Domus Artis

Use any robot, spider, search/retrieval application, or any other automated device, process, or means to access, retrieve, scrape, or index any portion of Domus Artis or its content

Rent, license, or sublicense Domus Artis

Defame, offend, harass, threaten, or otherwise violate the rights of others

Distribute or publish illegal, obscene, unlawful, defamatory, or inappropriate content

Illegally take over another User’s account

Register or use the Service to approach Users for the purpose of promoting, selling, or advertising products or services of any kind through Domus Artis

Use Domus Artis in any other improper manner that violates the Terms
Purchase
Order Cancellation The User may cancel an order within 24 hours of confirmation by communicating their intention using the contact details provided in this document. Domus Artis will refund any amount received within 5 business days from the date of the cancellation request. If the order has already been processed and the goods delivered, the User may exercise the right of withdrawal as outlined in the following sections.
Payment Methods Domus Artis uses third-party tools to process payments and does not come into contact with payment data—such as credit card information—provided by the User. Any handling fees for rejected payments will be charged to the User. More information on payment methods can be found in the relevant section.
Product Availability Prices, descriptions, or availability of products may change without notice. Photos are indicative and may not represent the products exactly. The Owner will do their best to present product features with the highest level of detail possible on Domus Artis, within each product’s dedicated page. However, images and colors of products offered for sale may differ from the actual items due to various factors, including but not limited to the User’s device monitor, photographic filters, etc. Therefore, the User acknowledges and accepts that such minor differences do not constitute a product defect.
Order Fulfillment Orders are fulfilled according to the terms specified on the summary page and in the Order Confirmation email, subject to product availability. The Owner shall not be held liable for damages suffered by the User due to delivery delays that are not foreseeable by either party at the time of the Order Confirmation.
Delivery
Deliveries are made during regular business hours to the address provided by the User and according to the methods specified in the order summary. Upon delivery, the User must check the contents and note any anomalies on the delivery form. If the order is not collected within the timeframe set by the carrier, the products will be returned to the Owner, who will refund the product price and shipping costs. If delivery occurs outside national borders, Domus Artis will not refund shipping costs or any applicable customs duties. The Owner cannot be held liable for delivery errors due to inaccuracies or incomplete information provided by the User when placing the order, nor for delays or damages occurring after the products have been handed over to the carrier, if the carrier was selected and appointed by the User. Further information on delivery methods can be found in the shipping section.
Right of Withdrawal
When purchasing products or services on Domus Artis, the User has the right to withdraw from the contract without providing any reason, within 14 days. The withdrawal period expires 14 days after the day the User or a third party—other than the carrier and designated by the User—takes physical possession of the goods. To exercise the right of withdrawal, the User must inform the Owner of their decision by sending an explicit declaration to the contact details provided.
The User may use the withdrawal form found in the “Definitions” section of this document, but is also free to express the decision in any equivalent format. In particular, the User may follow the procedure described in the “Return of Goods” section, while remaining free to use any other equivalent method.
Effects of Withdrawal
If the User withdraws from the contract, all payments made to the Owner will be refunded, including delivery costs (except for any additional costs resulting from choosing a delivery method other than the least expensive standard option offered), without undue delay and in any case within 14 days from the date the Owner is informed of the User’s decision. Refunds will be made using the same payment method used for the original transaction, unless the User has expressly agreed otherwise; in any case, the User will not incur any fees as a result of the refund. The refund may be withheld until the goods are received or until the User provides proof of having returned the goods, whichever comes first.
The User must return the goods to the Owner without undue delay and in any case within 14 days from the date the withdrawal was communicated. The deadline is met if the goods are shipped before the 14-day period expires. Return shipping costs are initially borne by the User, but will be refunded by the Owner under the conditions and limits stated above. The User is only liable for any decrease in the value of the goods resulting from handling beyond what is necessary to determine the nature, characteristics, and functioning of the goods.
The provisions in the “Delivery” section apply where compatible.
Limitations to the Right of Withdrawal
Returned products that are damaged or used beyond what is necessary to determine their nature, characteristics, and functioning will be refunded with a deduction for the resulting loss in value. Refunds are excluded when the loss in value is total. The User is asked to include a copy of the delivery document inside the return package.
The right of withdrawal is excluded for:

Goods made to measure or clearly personalized

Goods that may deteriorate or expire rapidly

Sealed goods that are not suitable for return for hygiene or health protection reasons and have been opened after delivery
If any of the above exceptions apply to the goods purchased, the User may not exercise the right of withdrawal.
Applicability of Withdrawal Clauses
The clauses regarding the right of withdrawal, its consequences, and exceptions apply exclusively to Users who qualify as consumers—that is, those acting for purposes unrelated to their business or professional activity.
Warranty
Users who purchase as consumers are entitled to a warranty for product and service conformity within 24 months of purchase, provided that the defect is reported within 2 months of discovery.
To exercise the warranty, the User must contact the Owner using the contact information provided in this document and give a detailed description of the defect. If a lack of conformity is confirmed, the User has the right to choose between repair or replacement of the product. The User may also request a price reduction or termination of the contract in the following cases:

If repair or replacement is impossible or excessively costly

If the Owner fails to repair or replace the product within a reasonable timeframe (no less than 15 days)

If previous repair or replacement caused significant inconvenience to the User
Defective products must be returned by the User.
Indemnity and Limitation of Liability
The User agrees to indemnify and hold harmless the Owner (including any subsidiaries or affiliates, representatives, directors, agents, licensees, partners, and employees) from any obligation or liability, including legal fees incurred in defense, arising from damages caused to other Users or third parties in connection with uploaded content, violations of the law, or breaches of these Terms of Service.
Limitation of Liability
Domus Artis and all functionalities accessible through Domus Artis are made available to Users under the terms and conditions of the Agreement, without any express or implied warranty, except where required by law. In particular, no warranty is provided regarding the suitability of the services offered for the specific purposes intended by the User. Use of Domus Artis and its accessible functionalities is at the User’s own risk and responsibility. Specifically, the Owner, within the limits of applicable law, shall be liable for contractual and non-contractual damages to Users and third parties only in cases of willful misconduct or gross negligence, when such damages are a direct and immediate consequence of Domus Artis’s activity. Therefore, the Owner shall not be liable for:

Any losses not directly resulting from a breach of the Agreement by the Owner

Any loss of business opportunities or other indirect losses suffered by the User (including, but not limited to, business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, etc.)

Damages or losses resulting from interruptions or malfunctions of Domus Artis due to force majeure or unforeseeable events beyond the Owner’s control, such as, but not limited to, failures or interruptions in telephone or electrical lines, internet network or other transmission systems, website unavailability, strikes, natural events, viruses and cyberattacks, interruptions in the provision of third-party products, services or applications

Improper or unsuitable use of Domus Artis by Users or third parties
General Provisions
Service Interruption To ensure the best possible experience for Users, the Owner reserves the right to interrupt the Service for maintenance or system updates, providing regular updates on Domus Artis.
Resale of the Service Users are not authorized to reproduce, duplicate, copy, sell, resell, or exploit any portion of Domus Artis or its Services without prior written permission from the Owner, either directly or through a specific resale program.
Privacy Policy For information regarding the use of personal data, Users should refer to the Domus Artis privacy policy.
Intellectual Property Rights All trademarks on the Application, whether figurative or word-based, and all other signs, trade names, service marks, brand names, commercial names, illustrations, images, and logos related to Domus Artis are and remain the exclusive property of the Owner or its licensors and are protected by applicable trademark laws and international treaties.
All trademarks and other signs, trade names, service marks, brand names, commercial names, illustrations, images, and logos related to third parties and content published by such third parties on Domus Artis are and remain the exclusive property or under the control of those third parties and their licensors, and are protected by applicable trademark laws and international treaties. The Owner does not own these intellectual property rights and may use them only within the limits and in accordance with the agreements made with such third parties and for the purposes outlined therein.
Age Requirements Users declare that they are of legal age under the applicable legislation. Under no circumstances may individuals under the age of 13 use Domus Artis.
Changes to These Terms The Owner reserves the right to modify these Terms at any time, notifying the User by publishing the changes within Domus Artis. By continuing to use Domus Artis after the publication of changes, the User accepts the new Terms without reservation.
Assignment of the Agreement The Owner reserves the right to transfer, assign, novate, or subcontract any or all rights or obligations under these Terms, provided that the User’s rights are not adversely affected. The User may not assign or transfer their rights or obligations under these Terms without the Owner’s written consent.
Communications All communications related to Domus Artis must be sent using the contact information provided in the Agreement.
Severability If any clause of these Terms is found to be invalid, void, or unenforceable, that clause shall be removed, and the remaining clauses shall remain unaffected and fully enforceable.
Applicable Law and Jurisdiction These Terms and all disputes regarding their execution, interpretation, and validity are subject to the law, jurisdiction, and exclusive competence of the court where the Owner has its registered office. An exception is made for the consumer’s exclusive jurisdiction, where provided by law.
